Planning Application for Rockwood ‘Wedding Venue’ / Reference Number: 23/0809/FUL
Meeting Commenced 7:00pm and finished approx. 8:15pm
Objector Comment – Previously, the developer was against 6 dwellings to North of Rockwood and engineered reports to be created to oppose this development. New consultation reports are counter to the developer’s consultation reports used when he opposed the small residential development on the corner of Kings Causeway/Halifax Road.
Objector Comment – Fraudulent use of Golf Report – Jonathan Gold produced a Golf Report for Nelson Golf Club to object to 6 dwellings which is now being used again to support this development. Golf Club members believe this is blatant fraud.
Impact on Road Infrastructure is the main objection – however, can’t mention cars damaging road / need to focus on planning reasons. It is damage to infrastructure and ways of getting to proposed venue.
Objector Comment – It was worked out that is there are 159 spaces with 3 functions a week for 52 weeks a year there will be an increase of 23,850 cars on Halifax / Burnley Road. If events take place 6 days a week there will be 47,000 more vehicles. It is important when objecting to mention Burnley Road and Nelson Road as well as Halifax Road. There is no room for expansion on either road so Burnley Council need to be involved. The Council put speed bumps on the road as they were concerned about speed. On Nelson Road the brow impacts on visibility.
Councillor Comment – Burnley Council are currently preparing response and are aware of the views of residents in Briercliffe.
Plans were provided by Burnley Council not Pendle – they also provided details about reasonable objections to planning and have spoken to the Deputy Leader of Pendle who stated Pendle Council had addressed concerns regarding minimum levels of consultation / it was stated that ‘Pendle Council have done what they were required to do legally’.
The nature of this application needs be discussed / debated as widely as possible by local residents – if this does not happen, Pendle council will ‘pull a fast one’ on residents.
Objector Comment – This person lived in Lane Bottom and pointed out that there are two roads linking Yorkshire/ Nelson / Colne. This development would aim to attract people from a wider geographical reach and therefore this development would have a serious impact on overwhelming the country lanes. The impact on the road infra-structure is more far reaching than just Halifax Road.
Objector Comment – Plans and documentation submitted contains misspelt names / different addresses so is actually inaccurate and unclear.

Can complain about process by complaining on Pendle Borough Council website or accessing Planning Department.

- Sue Woodward-Massey (SWM) provided an introduction and introduced key Councillors
- SWM had only become aware of the application through a post made on the Harle Syke Chronicle Facebook Page by Vicky Balmer.
- SWM stated there had been approx.: 500 objections to the application but she had been informed by the Planning Officer (Alex Cameron) that the comments emailed to him would not be counted in the numbers.
- Planning Information / Images of the plans and information on how to proceed as well as legal experience had been provided by Burnley Council not Pendle Council.
- SWM went on to outline the Purpose of the Meeting – Identify main objections covered / review issues with making objections and the planning process / identify next steps in taking action forward.
- Anyone who has not yet commented / would like to add to objection / have more than one person on household can still object. Any objections made must cover the main planning objections.
- Planning application process meeting date is currently 5th Feb but this may be postponed and updates will be provided.
- The venue planned is for 550 patrons / 60 staff with only 159 parking spaces allocated on site, 10 disabled spaces, 10 staff places.
- The reason that Briercliffe residents have been involved so much is that these are the residents who will be most heavily impacted by such a development as distinct from those living in Nelson/Brierfield as the Briercliffe residents are right on the border of the proposed venue.
- Nelson / Pendle Councillors were all invited and only one responded – Zafar Ali – he was not present.
- Main Reasons for objections were then summarised as follows:
- Change Land Usage - The proposed land for development is near an historic settlement / farm land / settlements / residences. This land is registered / noted as Green Space – this development is a change of land use to commercial use. This change of uses has been attached to the planning application. The land did not belong to Rockwood when purchased but according to the Land Register, this land was sold to developer for one pound in 2022 (Atkinson Family is referred to). Issues raised through Land Registry linked to restrictions will be researched further.

- Noise – Noise Documentation does not take account of windows being open /patrons moving in and out of building / car park noise / it states only 33 on terrace which is not realistic / no mention of fireworks.
- Light Emission – developer mentions blinds but they will not be put up to cover outdoor lighting even if dimmed down – glass marquee will impact on light emissions.
- Highway Congestion – road is already dangerous with a 40mph limit. Developer states he will reduce number of patrons if allocated car parking places are not suitable. LCC objected to visibility splays out of two entrances – one on site / other at driveway to Rockwood where coaches will be taken up and behind building to park behind building yet if there are more than two coaches, they will go off site – to where?

- Coal Mining – There is a deep coal mine seam on this site and the developer aims to remedy this danger by pumping in concrete – this is not ecologically friendly.
- Flood Issue – Local Flood Authority have opposed the plan fearing surface water run-off from the site. United Utilities state that this site is unsuitable and will not cope with the number of patrons and staff. There are no plans to replace sewers.
- Impact Animals - Livestock / horses / wild animals / domestic animals will be impacted on with noise / light / volume of people.
- Invasion of Green Spaces – this is an important area for people in Briercliffe, Brierfield and Nelson have tgo for mental health / well-being. A Planning Officer from LCC mentioned the Human Rights Act – people have the right to enjoy tranquillity / health benefits of green spaces – Council must take account this.
- Chairman Parish Council, Roger Frost has submitted a detailed objection from the Parish Council. He stated if people feel strongly, they MUST get involved and write to Pendle Council or if Highway matters to LCC.
- The main planning issues must be covered but if there are additional points, objectors can still add these. They won’t be counted if not planning issue but can still put in points. It is vital as many as many people as possible object.
- Two Articles came out last week in Nelson Leader and Burnley Express. Article in Burnley Express expressed applicant’s views – people need to write to Leader / add to planning website / County Council Website.
- Objector Comment – Works for Rossendale Council but lives locally – sheer visibility of site is issue – the public can write again to planning and add points – even if they have sent letter in and now got additional concerns, they can resend letter.
- Parish Council Letter will be available to view on their website once they have sought advice on this.
- Objector Comment – No need for another venue when already one agreed in close proximity – Developer wants this venue to be ‘equivalent to Ribble Valley Venues’ – the majority of these venues are long standing venues not new builds and alongside roads and residents. They are set in own land – this venue is not socially or economically viable.
- Objections linked to Fireworks / high speeding cars will not be considered as this is supposition and venue has not been advertised as an Asian Wedding Venue although some supporters did make reference to this initially.
- Objector Question –Where do people live who support application? – this cannot be divulged.
- Objector Question –Can the 9 main objections be made public / shared social media so these can be added to additional letters sent to Council? Yes, these will be available and minutes of meetings going to Lancashire Telegraph / Nelson Leader / Burnley Express
- Objector Question –What has happened with digger that appeared on Rockwood? People were in touch with Alex Cameron. This was exploratory work to support developer in additional report. People need to keep getting in touch with planning when they see anything happening. Alex Cameron stated he can’t stop development ahead of plan. Planning Enforcement Officer from Rossendale stated he can stop this under Section of Town Country Planning Act. He must be prepared to send Enforcement Officers. If anyone spots any work on site get in contact with Enforcement Officer – Julian Barraclough.
- Objector Comment – Objectors need to access expertise. Whether this was an application for a Wedding Venue / Night club / Brewers Fayre the objections would be the same.
- Objector Comment – NHS ask people to take responsibility for their own health. Birdwatchers / walkers / ramblers / golfers enjoy the area.
- During Golf competitions, a golfer takes a swing and the crowd goes quiet. This development will impact on the gold membership as the noise / light / structure will be distracting.
- Objector Comment – Pendle Council have the responsibility for the health of the Community – Zafar Ali is a Pendle Councillor and is the portfolio holder for environmental / climate change and protection – although invited, he has failed to attend. This has no benefit to the local community – no economic or social benefit. This same developer put in planning application for extension and this turned into creation of two houses, building started prior to planning permission being granted.
- Problems encountered with planning process were then discussed. This has included length of consultation and problems for many getting on portal. Again, these concerns need to be expressed in email to Alex Cameron or planning directly – Alex Cameron had 600 objections Friday to deal with and put on system. There is strong feeling but people must put this in writing.
- The application was submitted on the 4th of December over Christmas and had 21 days. This is the statutory minimum.
- Objector Comment – Serious concerns over process – Freedom of Information – plans in public domain but with things removed on Council Website for period of days then put back up when people complained.
- Objector Question – Which local people were notified? What Area? What procedures will be put in place so this does not happen again? – They met statutory requirement according to Maggie Lishman, Burnley Borough Councillor – only 2 letters went out – only need to be 200ms from the proposed venue. Two MPS from Burnley / Pendle managed to get further letters sent out and then extended period time to objections. It has been stated that Farmland is too far away to be considered. Nelson Golf Club received no letter nor did any residents on Kings Causeway.
- Councillor Comment - Pendle Borough Council sent information to minimal number of people. They did not consult Burnley or Briercliffe Parish Council. Parish Council Chair got information from internet and had to go to Town Hall at Nelson to review information – this is common practice for Pendle Council. This was a sensitive application just before Christmas / New Year. The Council should look twice at every application that comes in at this time of year as often significant problems.

- What Next? Need to move this forward, can’t stop.
- Meeting for Nelson / Brierfield / Reedley Area Planning Committee is planned for 5th Feb – need representation.

- SWM is prepared to lead this and share information on Facebook Pages as a forum of communication but wants an Action Group to form to represent all key areas i.e., Briercliffe / Harle Syke / Lane Bottom / Nelson etc
- If anyone has direct evidence of inappropriate behaviour by Pendle Council then they must contact the Borough Solicitor as it is their duty to investigate. If they do not act, contact Local Government Ombudsman.
- Objector Comment – Application proposed for Cemetery near by. If this is passed then numbers and functions will increase at venue. It will also put further pressure on infrastructure. At the moment though, we can only concentrate on this venue application.
- A Crowd Funding Page was suggested to get funding for Action Group i.e., legal guidance / consultancy.
- Councillor Comment - Planning Consultant is essential rather than legal advice but to take it all the way will cost.
- There was a private page set up to discuss the application / action but once the administrator of this page was seen to be allowing strange organisations on page / racist comments people left – SWM’s background is in equality / diversity rights so any communication will be through Facebook pages.
- Objector Comment – Bat Survey / Mature Trees / Badger Survey needs to be carried out. Need to push Council to carry these out. They have nominated groups they can go to. None of these have taken place.
- Pettys have currently re-advertised land to North of Rockwood with planning permission.
- Objector Comment – Roaming Rooster development had exactly the same objections made.
- People asked to share their name / email / skill set/ area with SWM so that an Action Group could be established.

Further, I understand that Burnley Borough Council was not sent any consultation details, about this application, until they asked for them. This cannot be right.
The Briercliffe Parish Council would like to OBJECT on the following grounds:-
To sum up, Briercliffe Parish Council feels that though such a facility may be needed in Pendle, or, perhaps, the wider area this is not that site. The Briercliffe Parish Council would like to OBJECT on the following grounds:-
- The application is for a large commercial business in an essentially semi-rural area on the boundary between Nelson and Briercliffe. This is also a residential area, most residential property being in either Nelson or Brierfield, in the area of King’s Causeway. Similarly, it is understood that a piece of land, immediately to the east of Rockwood Manor and King’s Causeway - the site of the former pill box, at Blackhills - is earmarked for further residential development. The site is, therefore, most unsuitable for a large commercial development of the kind proposed.
- The scale of the building, which described as the Rockwood Manor Glass Marquee, is considered to be much too large for the site for which planning permission is sought. The building will, similarly, be too large in relation to other buildings near the site.
- The building will be out of character for this location. It will be built of materials which do not relate to those that already exist in, or near to, the site and its design will, similarly, be out of character when compared with existing properties nearby.
- If the building is constructed, as indicated by the application, the site upon which it is built would be over-developed. (See 5, below) and out of character with the rest of the immediate locality whether in Nelson or Briercliffe.
- It is noted that the site will contain a (large) catering facility, will have 159 car parking spaces, will cater for 550 patrons, will have 60 plus employees and that new vehicle access will be required directly off Halifax Road. The Parish Council understands that the Lancashire County Council (LCC) Highways has already OBJECTED to the application on traffic grounds. If that is the case, the Parish Council would like to support the LCC, but it would like to add that these figures demonstrate just how large, and inappropriate, the application is for the chosen site. (It would have been better for the Planning & Building Control Office, of Pendle BC., to work with the applicants to locate a more sustainable site within the Borough for such a large application).
- Briercliffe PC is aware of the dangerous nature of Halifax Road, Nelson, which has traffic calming measures, and the narrowness of Nelson Road, in Briercliffe. Access to the site will not only be along Halifax Road, which has its own problems, some of the traffic using the facility, if granted permission, might be expected to use Nelson Road. As the LCC will be aware, there is a distinct “blind spot” on Nelson Road, near to Higher House, and close to Rookwood, which will be all the more dangerous if traffic is allowed to increase along Nelson Road.
- The Briercliffe Parish Council understands that the Coal Authority has either expressed reservations about the application or has OBJECTED to the application. Rockwood Manor is either very close to, or included, in a site of numerous early coal workings. The industry took place in this area, many years ago, before detailed records were kept of mining operations. The area was once known as “Blackhills” as a consequence of the coal mining that once took place there. The area should be fully investigated on account of its mining history (there are some maps etc in Nelson Library) and until that is done the Parish Council would support the Coal Authority.
- The Briercliffe Parish Council considers that a facility of the size indicated in the application is likely to cause nuisance to local residents – traffic has already been considered, but it is likely that noise and light pollution, given the nature of the facility, will add to problems particularly when considering the agricultural nature of the property to the south of the site.
- Briercliffe Parish Council considers that not enough consideration has been given to the environmental impact of the development. Some of this is covered in 8) above, but the site is very close to countryside. The applicants have not supplied detailed enough information on the possible impact of the application during is construction and fitting out stages and after the facility opens to the public.
To sum up, Briercliffe Parish Council feels that though such a facility may be needed in Pendle, or, perhaps, the wider area this is not that site. It would be a commercial business, operating on a large scale, in a residential and semi-rural area and its impact would have a considerable impact on those who live close to the site, and, probably, those who live further away, in the Catlow and Southfield areas. For the above 9 reasons Briercliffe Parish Council lodges its OBJECTIONS to this application.

Catherine Waudby has advised me that much, in my Statement, is acceptable, but I refute your accusations that “the Parish Council has constantly used slander and misinformation, on the Parish Council Facebook page, to discredit member(s) of the public”. In the letter of complaint, no supporting evidence on this was given. For my part, I do not use social media, including Facebook, though I use the internet. Never, have I succumbed to the use of slander and misinformation about any councillors, members of the public or in any of my Council roles during about 40 years of public service. Similarly, I am not aware that any of my colleagues have used slander and misinformation as is described.
Upon receiving the complaint, I suggested to Catherine Waudby that I am willing withdraw the sentence, “Each resigning member has cost the Parish Council £1,200 which could have been spent on services to the people of Briercliffe”. I did not intend to cause offence or distress by these words. They were used as what I thought to be an honest opinion, a statement of fact. The words were used in a spirit of transparency at a time when feelings, as you will appreciate, were running high.
The Monitoring Officer advises that, if the form of words I have used has caused offence, or distress, I should withdraw them. This is what I now do and I apologise for any offence or distress caused.

Chairman’s Statement at the October, 2023 Briercliffe Parish Council Meeting.
Thank you for electing me as Chairman. My colleagues know that I have been reluctant to allow my name to go forward at this stage. I will need theirs and your help.
I wish to make this Statement as the new Chairman of Briercliffe Parish Council. It is made on behalf of the four current members of the Council following the recent resignations of five other members.
First, I wish to thank former members for their contribution to the Parish Council, and Briercliffe, and wish them well for the future.
The present Council is committed to addressing the challenges which the Council faces and we are already working on areas that are the responsibility of current members and will work on other areas when Lead Councillors have been agreed.
Election.
There area now five vacancies on the Parish Council. We believe that they should be filled by election, rather than co-option. With others we have asked for an election and I understand that we have reached the necessary number for an election to take place. The election has a provisional date of November, 30th. The election will cost the Council about £6,000 (which represents 16.66% of our current Balance). These funds need not have been spent in this way. Each resigning member has cost the Parish Council £1,200 which could have been spent on services to the people of Briercliffe.
Working Together.
Our approach to the Parish Council’s work is the same as that which has been effective in the past. Our role is to represent everyone who lives in Briercliffe and report to them, to run effective and efficient services, and to work together, as a team, supported by the Clerk, to ensure that the Council is run properly and in the interests of residents.
After new councillors have been elected, we shall look together at the way we work and agree on the structure and systems.
Other Announcements.
I announce that I intend to Propose (not at this meeting but at the next) that my Chairmanship should be for just one year. I will not stand as Chairman for the year, 2024-5. In this I am Proposing that the Parish Council returns to having one-year Chairmanships, a system which worked very well until about 10 years ago. All of the members who would like to be Chairman can undertake the role. Those who do not want to be Chairman can choose not to do so.
I will also not take the Chairman’s Allowance which will therefore remain in Parish Council Funds.
I am also going to Suggest that the Parish Council re-introduces the Annual Christmas Dinner for members and the Clerk. There will be no cost to the Council as the members, as was the case in the past, will pay for their meals. (This may be a good method of getting to know the new members after the election next month).

Waiting lists
We were provided with the Scribe waiting list at the end of July:
5 waiting for a Pen & Garden
1 waiting for a Pen & Garage
4 waiting for a Pen
16 waiting for a Garden

Total 33 waiting.
Councillor Greenwood and I have contacted everyone on each list to confirm if they are still interested. This has been a mammoth task, which involved emailing, phone calls, door knocking, an on-site drop in, and social media contact. Councillor Greenwood took on many of the door-to-door visits and gathered heaps of information.
For allotments (gardens and pens), we confirmed removal of 13 from the list, who were no longer interested or had moved out of area. Four had already been allocated plots.
We have 6 Garages ready to let and confirmed with people ready to sign. However, we need to locate the keys so we can finalise inspections and allocate. The keys to the barrier have now been passed to us and we are undertaking access and inspection this month to allocate the empty garages.
Current Allotments tenants
We used drop-in events at the allotments and some of the same methods as for the waiting list to get hold of all current tenants to get all the details up to date and correct. We have found a number of details on the Scribe system which have changed, and some are no longer tenants; a small number also have incorrect names or plot numbers. We still have some tenant details to chase – in particular 2 plots and need to confirm use & details.
We now need to get all the up-to-date correct details into Scribe. Can we confirm if Scribe have refunded the monies paid to input the data, that we didn’t use them for so far? If not, can we confirm they can now do this from the data that has been collated?
New Allotment tenants
We signed up 18 during the first 2 weeks of September. On Sunday the 10th, all on the waiting list were allocated and agreed with 1 walk-up to be added to the waiting list
We have signed 21 new tenancies in the last 6 weeks. 2 more await final paperwork/ inspections.
A number of new tenants have been agreed a rent-free period to allow them to get the plot to a usable standard.
2023/4 Rent Statements
The Council is arranging to send out rent bills shortly. We are checking the position with the meter with United Utilities, but there will not be a water charge this year.
New Waiting List
Since signing everyone on waiting list, we have received 5 further contacts.
We understand that the online form on our Webpage seems to go to a spam folder. This online list was shared with Councillor Greenwood and me on 4th October – we are now contacting these applicants and cross referencing against previous checks to see if they want to remain on the list. The list had about 50 people wanting plots and garages. Several are duplicates of people we have already spoken with; a number have already been allocated, but there are many new ones. We are working through the list to confirm and allocate the remaining plots.
The Council currently has 7 empty Pens (3 large ones which we propose are divided into 2/3 garden plots each) and 1 which requires extensive tree works. This will mean there are potentially 13 vacant plots. We have provisional notice on 1 Garden and 1 pen to be finalised – these are ready to be allocated.
It is proposed that one current empty plot should be made into parking near to new gardens. costs for moving the tap and hardcore will be confirmed; we expect the cost to be about £300.
Taken together, these actions will lead to substantial extra income for the Council in the next financial year.
Deposit information
All new tenants have paid the agreed £100 deposit by bank transfer – 1 with Cash and 1 by Cheque (to be passed to the Clerk at our meeting).
We have 2 requests for refunds for past allotment tenant and 1 garage tenant deposits:
We would like to confirm all details of all deposits received to be included on Scribe records for all tenants, past and present. This ensures returns can be made as necessary and that we have a complete record; including details of those not to be returned, allowing us to confirm disposable finances for the plots that require work before reletting. Could the Clerk confirm a list of all deposits paid including amounts/method and plot details?
Still to do
Bonfire and BBQ 5th November from 4pm for Allotment holders and families. We are asking them to confirm to Councillor Greenwood or me so that we have likely numbers.
Supervised skips will be placed on the turning circle and Harrison Street for the morning of 28th October, with all the changes, they should be larger than usual. We request that no wood is added to skips as it will be used for bonfire. Tenants should inform us if they need us to store short term.
Next allotment inspection will be Thursday 2nd November from 3 p.m.

- Move tap near 24 to central
- Dry stone wall near new plots fallen/falling – agreed and booked in
- Investigate ‘bog’ with possible water leak – repair and hardcore path
- We are making plans for the allotment community to come together.

Remembrance Service 2022
A very good attendance. The Parish Council Chair laid a Wreath on behalf of all residents of Briercliffe and Extwistle.

We are deeply saddened to hear of the passing of Her Majesty Queen Elizabeth II on 8th September 2022.
We are all mourning the profound loss of a great Monarch who served our country so faithfully for all her life and who was loved the world over. An inspirational woman who will be remembered, respected and celebrated eternally.
The Union Flag on Duke St now flies at half mast to not only mark the passing of Her Royal Highness but also to offer our thoughts for the Royal Family, the loved ones she leaves behind and the people in every corner of the world whose lives she touched.
The Briercliffe with Extwistle Parish Council Book of Condolence will be opened and available in the next few days. We will confirm these details as soon as possible.

The Parish Council Christmas Hamper scheme is back up and running this year, residents over the age of 80 will received a small gift from the Parish Council. If you haven't had a hamper before and are over 80, please send your name and address to the Parish Council before the 12th November and your name will be added to the list.

UPDATE
Following the extension of restrictions the Community Centre will not reopen on the 21st June.
Briercliffe Community Centre has been closed since March 2020 but we are hoping to fully reopen after 21st June when Government rules allow. During the lockdown the Centre has been refurbished.
We are taking party bookings now for after 1st July.
All safety and hygiene rules are being followed.
